Licences and Regulatory Approvals in Ghana

Every entrant should build a licence matrix identifying the activity, regulator, applicant entity, legal basis, prerequisite, premises dependency, renewal and responsible executive. General business registration and GIPC status do not amount to a sector licence.

Common operating approvals may include local assembly business permits, planning and change-of-use approval, fire certification, environmental approvals and signage or public-health permissions. Requirements depend on location, premises and activity. Environmental approval should be sequenced before construction or operations where the project triggers assessment.

Sector overlays include Bank of Ghana authorisation for regulated banking, payments and financial activities; National Insurance Commission licensing for insurance; National Communications Authority permissions for communications services and equipment; Energy Commission and Public Utilities Regulatory Commission requirements in relevant energy activities; Minerals Commission licensing for mineral operations; Petroleum Commission requirements for upstream petroleum; Food and Drugs Authority registration for regulated foods, medicines, cosmetics and devices; and Ghana Standards Authority conformity requirements.

Regulated sectors may impose local ownership, local content, minimum capital, governance, fit-and-proper, physical-presence, technical, reporting or prior-change-of-control requirements. Apply the current sector rule to the precise product. A software provider to a bank is not automatically a bank, but a platform receiving or moving funds may enter payments regulation.

Do not sign an unconditional lease, import regulated goods or promise a launch date before critical approvals are mapped. Contracts with agents or consultants should define lawful services, prohibit improper payments and require records. Government-facing work should receive enhanced anti-bribery and conflict review.
