Immigration and Work Permits in South Africa

A foreign national may not work merely because the employer has incorporated or the person may enter as a visitor. Select the immigration route before fixing the start date. Potential routes include general work, critical skills, intra-company transfer and business visas, with corporate visas relevant in suitable large-workforce circumstances.

The correct category depends on the individual’s qualifications, occupation, employer, assignment and duration. A critical-skills application must match an occupation on the current list and meet the evidence requirements. The Department of Home Affairs’ critical-skills checklist calls for an employment offer or contract and confirmation from an appropriate recognised professional body, council, board or government department, among other documents. An intra-company transfer route is designed for an existing employee moving from an overseas company to its South African branch, subsidiary or affiliate and has route-specific employment and transfer evidence.

South Africa introduced a points-based assessment framework for specified work-visa routes, and immigration policy continues to develop. Use the requirements and forms in force when applying rather than relying on an older checklist or policy proposal. The March 2026 White Paper describes intended future reforms; it is policy direction, not itself a replacement visa law.

The employer should verify status, role restrictions and expiry before work starts; provide truthful corporate and employment documents; retain copies; monitor renewal; and report changes or cessation where required. The employment role and salary in practice should remain consistent with the approved application. Dependants require their own status and do not automatically acquire permission to work.

Immigration planning should run beside recruitment, professional registration and employment equity. A visa does not replace admission to a regulated profession, and an employer should not use an independent-contractor label to avoid immigration or employment duties where the factual relationship is employment.
